These Terms of Service (“Terms”) govern your access to and use of KaxaPage (“KaxaPage”, “we”, “us”, “our”), including our website and any hosted or downloadable software, dashboards, APIs, and related services (collectively, the “Service”).

By accessing or using the Service, you agree to these Terms.

1. What KaxaPage is

KaxaPage provides an ops panel and incident tooling (“incident engine”), including features such as incident timelines, access controls, status updates, and post-incident documentation.

2. Eligibility and authority

You must be at least 18 years old to use the Service.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Accounts and access

If accounts are enabled, you are responsible for:

  • keeping credentials confidential;
  • all activity under your account; and
  • keeping your information accurate and up to date.

4. Acceptable use

You agree not to:

  • use the Service in violation of applicable laws or regulations;
  • interfere with or disrupt the Service, networks, or security;
  • attempt to gain unauthorized access to systems or data;
  • upload malware or content intended to harm or exploit others; or
  • process, upload, or disclose data you do not have the right to use.

We may suspend or terminate access if we reasonably believe you violate these Terms or create risk for the Service or other users.

5. Customer Content

Customer Content” means data, text, files, incident details, and other content you submit to the Service.

You retain ownership of your Customer Content. You grant us a limited license to host, process, transmit, and display Customer Content only to provide, maintain, secure, and improve the Service and to meet our obligations under these Terms.

You are responsible for Customer Content, including obtaining all rights and permissions needed to submit it.

6. Privacy

Our collection and use of personal data is described in our Privacy Policy.

7. Self-hosted / open-source components

KaxaPage may be offered in different delivery models, including self-hosted deployments and (if applicable) open-source components.

  • Self-hosted use: you are responsible for your own infrastructure, configuration, access controls, backups, and security practices.
  • Open-source: if we publish any components under an open-source license, that license governs your use of those components. These Terms govern the Website and any non-open-source parts of the Service.
  • Third-party dependencies: the Service may include third-party software subject to their respective licenses.

8. Early access / beta

Some parts of the Service may be offered as early access, beta, or preview features (“Beta Features”). Beta Features may be incomplete, may change, and may contain bugs.

To the maximum extent permitted by law, Beta Features are provided “AS IS” and “AS AVAILABLE.”

9. Third-party services

The Service may integrate with or link to third-party services (for example, chat platforms, monitoring tools, ticketing systems, or status pages). Your use of third-party services is governed by their terms and policies. We are not responsible for third-party services.

10. Fees (if applicable)

Some plans may require payment. Pricing, billing frequency, and plan details will be described at the point of purchase or in a separate order form.

Unless otherwise stated, fees are non-refundable and taxes may apply.

11. Intellectual property

The Service (including software, design, branding, and documentation) is owned by KaxaPage or its licensors and is protected by intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service except as expressly allowed by these Terms or applicable law.

12. Feedback

If you provide feedback or suggestions, you grant us the right to use and incorporate that feedback to improve the Service, without restriction or compensation.

13. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind (express, implied, or statutory), including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free.

14. Limitation of liability

To the maximum extent permitted by law:

  • KaxaPage will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill; and
  • our total liability for any claims arising out of or related to the Service will not exceed the amounts you paid to us for the Service in the 12 months before the event giving rise to the claim (or €100 if you have not paid anything).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15. Suspension and termination

You may stop using the Service at any time.

We may suspend or terminate access to the Service:

  • if you violate these Terms;
  • to comply with law or requests from authorities;
  • to protect the security or integrity of the Service; or
  • if the Service is discontinued.

Upon termination, your right to use the Service stops. Sections that by their nature should survive will survive termination (including Intellectual Property, Disclaimers, and Limitation of Liability).

16. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will provide reasonable notice (for example, by posting an update on the website or notifying account owners). Continued use of the Service after the effective date means you accept the updated Terms.

17. Governing law

These Terms are governed by the laws of Spain, without regard to its conflict-of-laws rules.

If you are a consumer in the EU/EEA, you may have additional rights under local consumer laws.
